The Build America, Buy America Act (“BABA”) requires that all iron and steel, construction materials, and manufactured products used in federally funded infrastructure projects are produced in the United States. This requirement, known as the Buy America Preference (“BAP”), is detailed in the Infrastructure Investment and Jobs Act, Pub. L. 117-58 and 2 CFR 184.
NDHFA works closely with subrecipients, developers, architects, and contractors to ensure products used in HUD-funded multifamily affordable housing projects greater than four units are documented as being produced in the United States, as required.
BABA requirements are applicable to all HOME Investment Partnership and National Housing Trust Fund program awards on or after each program’s 2024 grant year.
